Andrew Hesketh is one of our Heads of Clinical Negligence, bringing over two decades of legal expertise to the role, 11 years of which have specifically been focussed in clinical negligence. Andrew oversees legal teams in Fletchers’ Southport office, guiding them towards meeting objectives, progressing claims, and providing support through litigation.  

Andrew has expertise across the full range of clinical negligence claims including complex birth injury and Cerebral Palsy claims. He finds fulfilment in representing clients facing challenging circumstances, seeking answers, recognition, and apologies for incidents beyond their control. Andrew’s dedication lies in accompanying clients on their journey, ultimately witnessing their improved circumstances and positive outlooks.

ANON:  

The Claimant had to undergo emergency surgery following a failure by an NHS Trust to identify a blood clot, that resulted in the Claimant developing ischaemic bowel and resulted in a large part of his bowel being removed.   The Claimant required treatment in ICU before then developing a significant and inoperable incisional hernia at the site of his emergency bowel surgery. The Claimant had significant issues with daily living and significant care needs as a result of this large sized hernia, which medical experts confirmed would be lifelong. The claim was defended robustly by the Defendant, despite admissions being made in relation to the issue of breach of duty, but ultimately settled at a mediation with the Defendant’s representatives, with the Claimant receiving damages of £294k.

Andrew and his team represented the parents of a young child that tragically lived for only 24 hours after catastrophic clinical failings during the mother’s labour and delivery, ultimately obtaining compensation for them for their loss, but more importantly answers to the many questions that they had regarding what had happened, that the Trust were initially not forthcoming with. 

 

ANON   

Andrew and his team worked on a claim on behalf of the estate of a man who tragically died on holiday due to a failure in the weeks preceding this. An NHS Trust failed to diagnose a myocardial infarction and provide appropriate treatment, leading to a further, more significant myocardial infarction occurring that sadly caused his death.  Liability was initially denied, and Court proceedings had to be pursued, before the claim was ultimately concluded successfully for the Claimant and the estate.
